JOHANNESBURG - The Public Protector has filed notice to oppose the application to review her CIEX report in which she proposed Constitutional amendments related to the role of the Reserve Bank.
The report follows an investigation of an apartheid era bail-out for Absa’s predecessor Bankorp.
The Public Protector’s office says that the remedial action in the CIEX report does not in any way amend the Constitution.
It says that the remedial action also doesn’t violate any parliamentary process.
Instead, the Public Protector says that the chairperson of the Portfolio Committee on Justice and Correctional Services must initiate the process of amending the Constitution in the National Assembly.
The Public Protector says this process should be carried out in accordance with the Constitution.
Advocate Busisiwe Mkhwebane has filed notice to oppose and will file her answering affidavit next week.
